VOTING PROCEDURE

Voting Procedure - Electoral Offenses

 The following offences as stipulated by LASIEC Law 2008 (as amended) are applicable to poll Officials, Candidates, Party Agents, Officials and members of Staff of the Commission, Police Officers and any other person that may be involved with the conduct of the election-on-election days.

  • Breach of Official Duty: It shall be an offence for any Poll Official, Police Officers, members of SSS, Staff of the commission, Party Agents etc to fail to perform or discharge his/her duty or perform his/her duty fraudulently or breach his/her official duty. Such person(s) shall be liable to payment of between N50, 000:00 and N100, 000:00 fine or imprisonment for a term from 6 months to 1 year or both.

 

  •  Breach of Official Secret: It shall be an offence for any person to breach his/her duty of maintaining the secrecy of voting or interfere with a voter when casting his/her vote without permission. Punishment is imprisonment foa term of 1 year without option of fine.

 

  •  Impersonation: A person who impersonates another person in-order to vote in the name of that other person shall be guilty of the offence of impersonation and liable to a fine or imprisonment for a term of 1 year or both.

 

  •  VIOLENCE, UNDUE -INFLUENCE AND THREATENING: Any person (s) who uses or threatens to use force or violence or injures another to compel a person to vote or refrain from voting shall be guilty of threatening and liable to a fine or imprisonment for a term of 1 year or both.

 

  •  ELECTORAL MALPRACTICE: Any person who forges or counterfeits a ballot paper or official mark on a ballot paper or statement of result or fraudulently puts a ballot paper into a ballot box without authority or fraudulently takes out a ballot paper from a polling station or destroys, takes-away or in~rferes with a ballot box or ballot paper from a poHing station shall be guilty of an offence punishable with fine stipulated or imprisonment for a term of 1 year or both.

 

  •  Voting where not registered: A person who willfully votes in a ward where his/her name does not appear in the register of voters shall be guilty oa na offence and liable to a fine or imprisonment for a term of 1 year or both.

 

  •  Disorderly Conduct: Any person(s) who acts or incites others to act in a disorderly manner at any Polling stations or collation centre shall be quilty of an offence and liable to a fine or imprisonment for a term of 1 year or both.

 Other Offences: Any person who engages in the following:

a) Canvassing for votes.

b) Soliciting for vote of any voter.

c) Persuading any voter not to vote for any particular candidate

d) Persuading any voter not to vote at the election

e) Shouting slogans concering election

f) Being in possession of any acid, offensive weapon or missiles or wearing any dress or having any facial or other decoration which in any event is calculated to initimate voters.

g) Exhibiting, wearing or tendering any notice, symbol, sign, token, photograph or party card referring to the election.

h) Using any vehicle bearing the colour or symbol of a Political Party by any means whatsoever.

i) Loitering without lawful excuse after voting or after having been refused to vote.

j) Convening or holding or attending any public meeting or, unless appointed under the law, operating any megaphone, amplifier or public address apparatus for the purpose of making announcements concerning the election,

k) Erasing or altering any information on the voter’s card belonging to another person, whether that person is living or dead.
